Please read our GENERAL POLICIES carefully and completely. These GENERAL POLICIES apply to all product information, product purchases and product services, “Orders” made either on-line using the World Wide Web system (Internet) by and through the auspices of DVDs4Less.net or communications directly through our DVDs4Less office in Sparks, Nevada.


By placing a Work Order Authorization for Orders from DVDs4Less and DVDs4Less.net "SELLER", customer "BUYER" and Buyer’s agents and assigns agree to be bound by the General Policies and Warranty Statement contained herein. Any attempt to alter, supplement, modify or amend the General Policies or Warranty Statement, will be considered as a material alteration of an Agreement between the Buyer and the Seller and, therefore, is void with or without notice to the Buyer or by the Buyer’s acknowledgment. In addition, these General Policies and the Warranty Statement are subject to change at any time, with or without prior written notice to the Buyer. Please check and read these policies, terms and conditions carefully, each time, before placing an order or doing business with DVDs4Less and DVDs4Less.net.


Technical Support

DVDs4Less and DVDs4Less.net shall not be responsible for providing misleading and/or what might be a misunderstanding of technical information, even if such misleading information or misunderstanding of technical information is intentional. Buyer should contact the original manufacturer, if any, or knowledgeable industry sources for assistance on issues related to compatibility, suitability, playback or any other technical questions.

DVDs4Less and DVDs4Less.net MAKES NO REPRESENTATION for any product it provides, service or process, of a Warranty there upon unless such Warranty is specified within these General Policies and/or within the Warranty Statement listed under a different section of this DVDs4Less website.

DVDs4Less and DVDs4Less.net MAXIMUM LIABILITY, IN ALL CIRCUMSTANCES, IS LIMITED TO THE SELLER’S REPLACEMENT COST OF THE PRODUCTS AND SERVICES “ORDERS” SOLD BY THE SELLER TO, AND PURCHASED BY, THE BUYER. DVDs4Less and DVDs4Less.net SHALL NOT, UNDER ANY CIRCUMSTANCE, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS AND SERVICE IT PROVIDES WHICH EXCEEDS THIS MAXIMUM LIABILITY .   DVDs4Less and DVDs4Less.net SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE BUYER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT DVDs4Less and DVDs4Less.net IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES. DVDs4Less and DVDs4Less.net SHALL NOT BE RESPONSIBLE FOR ANY LOST DATA, ONLINE ERRORS, DISPLAYING ERRORS, ONLINE PAGE ERRORS OR ANY ONLINE PROCESSING ERRORS THAT HAVE BEEN CAUSED BY SOFTWARE, COMPUTERS OR BY HUMAN ERROR OR FOR ANY OTHER REASON EVEN IF SUCH REASON OR HUMAN ERROR IS KNOWN TO THE SELLER PRIOR TO COMMENCEMENT OF ANY TRANSACTION. DVDs4Less and DVDs4Less.net SHALL NOT BE LIABLE FOR ANY LOSS OF EMAILS OR OTHER COMMUNICATION OF ANY KIND OR MANNER DUE TO TECHNICAL OR HUMAN ERROR. DVDs4Less and DVDs4Less.net SHALL NOT BE RESPONSIBLE FOR MAKING CORRECT AND/OR CORRECTING SPELLING, PUNCTUATION, COLOR, POSITIONING, FONTS OR OTHER ERRORS OR OMMISIONS ASSOCIATED WITH CUSTOMER-SUPPLIED GRAPHICS AND/OR MEDIA MASTERS SENT TO DVDs4Less and DVDs4Less.net FOR DUPLICATION INCLUDING, ORIGINAL GRAPHICS BUILT AND DESIGNED BY DVDS4Less and DVDS4Less.net FOR THE BUYER OR BUYER’S AGENT OR ASSIGNS WHICH HAVE BEEN APPROVED IN ANY MANNER BY THE BUYER FOR USE. FURTHER, THOSE APPROVALS ARE RELATED TO ANY PRINTING, COPIES AND DUPLICATION OF THE BUYER'S PROGRAM PROVIDED FOR DUPLICATION. DVDs4Less and DVDs4Less.net SHALL NOT BE RESPONSIBLE FOR AUDIO FIDELITY OR MIXING OF SOUND TRACKS, VIDEO AND VIDEO QUALITY, COLORIMETRY, PROGRAM CONTINUITY, SYNCHRONIZATION OF AUDIO WITH PICTURE OF THE CUSTOMER PROGRAM INCLUDING BUT NOT LIMITED TO ERRORS AND OMMISIONS AND MISSPELLED WORDS AND OR GRAPHICS CONTAINED ON, WITHIN AND TO MASTER PROGRAM(S) PROVIDED BY CUSTOMER FOR DUPLICATION. DVDs4Less and DVDs4Less.net SHALL NOT BE RESPONSIBLE FOR ESTIMATED TURN-AROUND TIMES, (TURN TIMES), TIME ESTIMATES FOR PROCESSING EACH ORDER AND ESTIMATED DELIVERY DATES BACK TO THE BUYER.  ESTIMATED TURN TIMES AND ESTIMATED DELIVERY DATES ESTABLISHED IN ANY FORM TOGETHER WITH ANY DELIVERY DEADLINES BACK TO THE BUYER ARE ESTIMATED ONLY AND NOT GUARANTEED BY THE SELLER. ESTIMATED SPEEDS OF SERVICE ARE BASED UPON BUSINESS DAYS EXCLUDING WEEKENDS AND ALL HOLIDAYS AND ARE NOT GUARANTEED FOR SPEED OF PROCESSING OR RETURN DELIVERY BACK TO THE BUYER FROM SELLER UPON ANY ESTIMATED DATE, EVEN IF SELLER HAS PROVIDED BUYER WITH AN ESTIMATED TIME OF DELIVERY. DVDS4LESS AND DVDS4LESS.NET SHALL NOT BE RESPONSIBLE FOR DUPLICATING OR MAKING COPIES OF A LATENT TECHNICAL ERROR OR A PLAYBACK INCOMPATIBILITY EMBODIED IN THE BUYER’S MASTER DISC MEDIA PROVIDED WITH THE BUYER’S ORDER FOR DUPLICATION, TO THE SELLER.


Order Process Information, Requirements & Estimated Speeds of Service

Duplicated Orders made by Seller and/or master elements used to duplicate Buyer’s Order normally ship out within two business days after receiving Buyer’s order and materials to be duplicated, copied and printed excluding all holidays and weekends. DVDs4Less and DVDs4Less.net may contact Buyer regarding the Order Buyer has placed and, for any reason, may hold Buyer’s Order for processing until such time as the Buyer has been directly contacted. If, for any reason, Buyer cannot be reached by Seller, Buyer’s Order will be placed on indefinite hold and all work related to the Buyer’s Order shall cease. DVDs4Less and DVDs4Less.net shall not be responsible for any on hold Orders for which the Seller may cause any additional delays, regardless of whether such delays are reasonable or justifiable. It is the Buyer’s sole responsibility to make sure that all requested information for each Work Authorization Order is input clearly, completely and correctly. Buyer may contact DVDs4Less.net anytime during normally business hours (PST) or 24 hours through email or by calling our toll free number (800) 852-2330 during normal business hours as listed on the Contact page.


STANDARD 2-DAY SERVICE

In one day and out the second day standard 48 hour service.

Example: In Monday shipped out Wednesday night. Service days are business days excluding holidays and weekends. Speed of Service, turn times and precise delivery times are estimated and NOT guaranteed.

1-DAY EXPRESS SERVICE*

In one day and out the next day 24 hour service by appointment. Add 5% to standard 2-day prices.

Example: In Monday morning shipped out Tuesday night. Service days are business days excluding holidays and weekends. Speed of Service, turn times and precise delivery times are estimated and NOT guaranteed.

SAME-DAY DAYLIGHT SERVICE*

In one day and out the same day by appointment. Add 10% to standard 2-day prices.

Example: In Monday morning shipped out Monday night. Service days are business days excluding holidays and weekends. Speed of Service, turn times and precise delivery times are estimated and NOT guaranteed.


On Hold Status

On Hold Status is defined as an Order that cannot be processed due to a Seller perceived error regardless of whether such error is reasonable or justifiable. Seller may hold Buyer’s Order for some, but not limited to, any or other of the following reasons:

  • Credit card information cannot be verified.
  • Billing information and/or shipping information cannot be matched.
  • Credit Card has been rejected due to human or mechanical error.
  • Receiver does not match credit card record as authorized user.
  • Graphic text appears to be misspelled or incorrect.
  • Graphics are not sized correctly to fit our templates.
  • Buyer’s master cannot be played back on a normal machine.

To prevent any delay of shipments, Buyer should make sure to correctly input all Seller-requested information. Seller reserves the right to cancel any Order that Seller is unable to verify or process. Seller reserves the right to refuse any Order for reasons including, but not limited to, content is child pornography, customer is not the copyright holder of the product or for any other reason.


LOST OR DAMAGED PACKAGE(S)

DVDs4Less and DVDs4Less.net limited liability

DVDs4Less and DVDs4Less.net does not hold any responsibility for any loss of shipment due to shipping carrier's mistakes or wrongdoings. In addition, however, DVDs4Less and DVDs4Less.net may issue a second shipment, at its sole discretion, under special conditions, 15 days after Buyer claims the package to be lost. Under any CIRCUMSTANCES, DVDs4Less and DVDs4Less.net liability is limited to assisting in package locating, and to provide second shipment upon approval, if any, by DVDs4Less and DVDs4Less.net.


Shipping Methods

DVDs4Less and DVDs4Less.net offers UPS, U.S. Postal Service, Federal Express, DHL and/or other shipping methods at our discretion. Seller does not ship to APO, FPO, US Ship or outside the 50 United States of America.

UPS and the USPS DO NOT SHIP ON HOLIDAYS OR WEEKENDS. DVDs4Less and DVDs4Less.net is NOT OPEN DURING WEEKENDS OR ANY HOLIDAYS.

A cleared Order is defined as an Order that is completely finished, without Seller questions or On Hold Status delays, and is available for shipping. Components of a cleared Order include, but are not limited to, the payment status of the Buyer, the billing and shipping information validity, the day of the week when Order is ready to ship and the availability of the Order.

All cleared Orders will be processed and shipped within 2 business days unless Seller notifies Buyer of a different estimated delivery date.

Due to uncontrollable variables, the delay of the availability of an item is sometimes inevitable. In cases when the Buyer has selected a backordered item or service, Seller will contact Buyer via telephone or email for the newly revised and estimated arrival time of the delayed shipment. When Buyer has confirmed with Seller its decision to wait for the shipment, Buyer's order will be shipped automatically when it becomes available as a cleared Order.

Ground Shipping is only available to the 50 United States of America.

To ensure delivery, Seller only ships to physical addresses.

Seller does not ship to Post Office Boxes or General Delivery addresses.

DVDs4Less and DVDs4Less.net reserves the sole right to determine the kind, character, manner and nature of its free shipping service of WHOLESALE orders. 

Selected items have restricted shipping options, based on size and weight of the product. See SHIPPING page for limitations.

Free shipping may take up to 7-12 business days for delivery and is limited to the 50 United States of America.  Seller reserves the exclusive right to choose the mode and speed of delivery and the shipping carrier.

All cleared orders placed before 12:00 noon PST of a business day will be processed within two (2) days as defined by and subject to the SPEEDS OF SERVICE contained on the Shipping page.  NOTE: Once a package has left Seller’s plant for delivery or has been delivered to the carrier for shipment, Seller cannot alter any information and will not be held responsible for any errors or delays caused by the shipping carrier.

Please be aware that shipments made to Alaska and Hawaii could be delayed up to an additional five (5) business days due to weather and other factors beyond Seller’s control.

Once a package is dropped off to the carrier for delivery, Seller does not have any control over the delivery; therefore, Seller cannot make any guarantees of estimated delivery times back to the Buyer. In cases of errors or delays caused by the shipping carrier or by Seller, Seller will help, but cannot guarantee, and shall not be responsible to resolve any shipping dispute.


Cancellation of Orders

When the Buyer agrees to purchase Seller’s service and when an Order is submitted by the Buyer, charged and paid for by credit card or other legal financial instrument, that Order CANNOT be canceled under any circumstance. Most of Seller’s Orders are processed within 24-48 hours.


Changes of Price and Services

DVDs4Less and DVDs4Less.net reserves the right to change any price, manner of service, materials or speed of service at anytime. All pricing errors are subject to correction. We reserve the right to refuse any order.


Refusal of Service

DVDs4Less and DVDs4Less.net reserves the right to refuse any order or request for service for any reason and at any time.


Typographical Errors

DVDs4Less and DVDs4Less.net is not responsible for typographical errors, price differences, manners of service, speed of service or coupon code validity posted by forums, any 3rd party or an affiliate.


Ownership Of Materials

DVDs4Less will accept all materials for duplication that Buyer has the absolute ownership and right to duplicate. DVDs4Less will not duplicate any known copyrighted property such as feature films and any other copyrighted programs that contain VIDEO, AUDIO, COMPUTER FILES or any other copyrighted materials unless Buyer can show copyright ownership, in writing. By submitting any Order for duplication, Buyer warrants that it has the sole right and authority to make copies and duplicate all Order content including media and graphics. Buyer shall hold Seller harmless and, for any reason, shall legally defend Seller in causes of action arising from Buyer’s unauthorized use of media and graphics contained in an Order submitted for duplication to the Seller.

NO CHILD PORNOGRAPHY

DVDs4Less is not the morality police. What Buyer chooses to duplicate is Buyer’s sole responsibility to defend and represent as a legal practice under all local, State and Federal laws in the United States of America. However, any Order that Seller might believe to contain child pornography will be rejected, will not be duplicated and will be returned at sender’s expense with no further recourse 6to the Buyer.

Protection Copy

Unless instructed otherwise, DVD4Less will hold one extra protection copy, “Protection”, DVD or CD copy of Buyer’s Order for sixty (60) days at no additional cost to the Buyer. This practice of holding one Protection copy of the Order is a safety precaution to generally cover that interval of time when products are in transit between the Seller and the Buyer. This Protection is not a backup copy or a replacement for any original elements and is not intended to be anything except an isolated Protection duplicate copy kept for safe keeping by Seller during the general time of transit between Seller and the Buyer who paid for the duplication. BEFORE SENDING ANY MATERIALS TO DVDs4Less FOR DUPLICATION, YOU ARE EXPRESSLEY ADVISED TO MAKE AND KEEP AT LEAST ONE DUPLICATE SUB-MASTER COPY OF THE MASTER FOR YOUR OWN PROTECTION AND REPLACEMENT OF YOUR MASTER.

No Changes To Program Content

DVDs4Less is a media duplicator and not a production house. Seller will not mix audio, change video or modify any feature of an Order sent by Buyer for duplication.

Terms Of Payment

DVDs4Less requires an advance deposit of fifty per cent (50%) advance payment of the Order Work Authorization and the balance 50% of the Order Work Authorization is due upon completion of duplication and before return shipment of the Order and Buyer master duplicating materials or any other Buyer provided element or service Buyer has ordered from or delivered to Seller.

Unpaid Balances

DVDs4Less reserves the right to hold all original elements and copies sent to us for duplication and related services until the DVDs4Less duplication services bill for service rendered is paid in full.


Miscellaneous

These policies and Warranty Statement shall be binding upon the successors and assigns of SELLER and BUYER. THE PROVISIONS OF THESE POLICIES AND WARRANTY STATEMENT ARE SEVERABLE AND IF ANY TERM, CONDITION OR PROVISION IS HELD TO BE ILLEGAL, INVALID OR OTHERWISE UNENFORCEABLE, IN WHOLE OR PART, SUCH HOLDING SHALL NOT BE CONSTRUED AS IMPAIRING THE ENFORCEBILITY OF ANY OTHER TERM, CONDITION OR PROVISION OF THESE POLICIES AND WARRANTY STATEMENT and they shall continue in full force and effect as if the terms, conditions or provisions held illegal, invalid or otherwise unenforceable were not originally included herein.

All litigation costs including but not limited to, reasonable attorney's fees and expenses, collection fees and expenses, or other costs incurred in any claim or proceeding brought by Seller against Buyer or by the Buyer against Seller in connection with each Order, product or service , term, condition or provision of these policies and warranty statement, or any provision thereof or hereof, shall be paid in full by the losing litigant.

Place of Venue for presentation of claims, proceedings, legal action or litigation shall be in Washoe County District Court, Washoe County, Nevada.

These General Policies and Warranty Statement shall supersede all current or previous Policies, Warranty Statements and/or legally binding Agreements made between the Seller and the Buyer. Buyer and Seller agree that there are no other understandings or agreements between Seller and Buyer.

I have completely read the entire General Policies and the Warranty Statement and I completely understand their purpose, meaning, and intent to clarify precisely, the conditions upon which the Seller renders service to the Buyer and the Warranty extended to the Buyer from the Seller. I authorize DVDs4Less and DVDs4Less.net to charge my credit card for the TOTAL SUM listed on my signed, WORK AUTHORIZATION FORM.
